Kraina Tuptusia Newsletter Regulations
§ 1 DEFINITIONS
Newsletter - a free electronic service provided by which the Service Recipient can receive electronically ordered messages from the Service Provider regarding the Store, including information about offers, promotions, and news in the Store.
Store - Kraina Tuptusia online store operated by the Service Provider at www.krainatuptusia.pl
Service Provider - ALEKSANDRA MARIA MACURA, an entrepreneur conducting business under the name Kraina Tuptusia Aleksandra Macura, registered in the Central Registration and Information on Business conducted by the minister competent for economy and managing the Central Registration and Information on Business, Tax Identification Number (NIP) 5472213295, National Business Registry Number (REGON) 383805050, ul. Kozia 3/27, 43-300 Bielsko-Biała.
Service Recipient - any entity using the Newsletter service.
§ 2 Newsletter
1. The Service Recipient may voluntarily use the Newsletter service.
2. To use the Newsletter service, it is necessary to have a device with an up-to-date internet browser that supports JavaScript and cookies, access to the Internet, and an active email account.
3. The email messages sent as part of this service will be sent to the email address provided by the Service Recipient when signing up for the Newsletter.
4. To sign up for the Newsletter service and enter into a contract for the provision of the service, the Service Recipient first provides their email address in the designated place on the Store website, where they wish to receive messages sent as part of the Newsletter. Then, the Service Provider will send the Service Recipient an email message to the email address provided in the first step, containing a link to confirm the Service Recipient's intention to sign up for the Newsletter. Once the Service Recipient confirms their intention to sign up for the Newsletter, a contract for the provision of the service is concluded, and the Service Provider will begin providing the service to the Service Recipient.
5. The email messages sent as part of the Newsletter will include information about the possibility of unsubscribing, as well as an unsubscribe link.
6. The Service Recipient can unsubscribe from the Newsletter at any time, without giving any reason and without incurring any costs, by using the option specified in item 5 or by sending a message to the Service Provider's email address: biuro@kraintuptusia.pl.
7. Using the unsubscribe link or sending a request to unsubscribe from the Newsletter will result in the immediate termination of the contract for the provision of this service.
§ 3 Complaints
1. Complaints regarding the Newsletter service should be reported to the Service Provider via email: biuro@kraintuptusia.pl
2. The Service Provider will address the complaint within 14 days of receiving the complaint notification.
OUT-OF-COURT DISPUTE RESOLUTION AND CLAIMS ENFORCEMENT
3. In the event that the complaint handling procedure does not produce the expected results for the Consumer, the Consumer may use, among others:
- mediation conducted by the relevant Voivodeship Inspectorate of Trade Inspection, to which the Consumer should apply for mediation. In principle, the mediation procedure is free of charge. The list of Inspectorates is available here: https://www.uokik.gov.pl/wazne_adresy.php#faq595;
- assistance of the relevant permanent amicable consumer court operating at the Voivodeship Inspectorate of Trade Inspection, to which the Consumer should apply to have the case heard by the amicable consumer court. - free assistance of the municipal or district consumer advocate;
- the online dispute resolution (ODR) platform available at: http://ec.europa.eu/consumers/odr/.
§ 4 Personal Data
1. The Service Provider is the administrator of the personal data provided by the Service Recipient when using the Newsletter service.
2. The personal data of the Service Recipient is processed mainly based on the contract and for its execution, in accordance with the principles set out in the general regulation of the European Parliament and the Council (EU) on data protection (GDPR). Detailed information regarding the processing of personal data by the Service Provider is contained in the privacy policy posted on the Store's website.
§ 5 Final Provisions
1. The Service Provider reserves the right to amend these regulations for important reasons only. A valid reason includes the need to change the regulations due to the modernization of the Newsletter service or changes in the law affecting the provision of the service by the Service Provider.
2. Information about the planned change to the regulations will be sent to the email address provided by the Service Recipient when signing up for the Newsletter at least 7 days before the changes come into effect.
3. If the Service Recipient does not object to the planned changes before they come into effect, it will be deemed that they accept them.
4. In the event of a lack of acceptance for the planned changes, the Service Recipient should inform the Service Provider about this by sending a message to the email address: biuro@kraintuptusia.pl, which will result in the termination of the contract for the provision of the service when the planned changes come into effect.
5. The provision of unlawful content by the Service Recipient is prohibited.
6. In the event of any dispute with the Service Recipient who is not a consumer, the court having jurisdiction will be the court having jurisdiction over the seat of the Service Provider.
7. The contract for the provision of the Newsletter service is concluded in Polish.
